Hal ini berawal dari urgensi isu perubahan iklim dan lingkungan hidup yang telah menjadi komitmen Indonesia dalam beberapa tahun terakhir. Indonesia telah menetapkan target untuk mengurangi emisi sebesar 31,89% secara mandiri serta 43,2% dengan bantuan internasional pada 2030 Reuters, 2022. Selain itu, melalui ratifikasi Perjanjian Paris dan target net zero emissions pada 2060, Indonesia jelas mengambil langkah besar dalam aksi pencegahan perubahan iklim Reuters, 2022. Salah satu bagian dari pencegahan perubahan iklim tersebut adalah peralihan dari energi konvensional menjadi energi baru dan energi terbarukan EB-ET. Ketergantungan Indonesia terhadap penggunaan energi yang berasal dari sumber energi fosil, seperti batu bara, masih sangatlah tinggi. Oleh karena itu, Indonesia memerlukan sebuah perubahan besar dalam peralihan energi. Perjanjian Just Energy Transition Partnership JETP yang merupakan dekarbonisasi penggunaan batu bara untuk ekonomi menjadi contoh nyata komitmen Indonesia dalam penghentian penggunaan batu bara serta peralihan energi Hashem, 2023.Namun, berbagai kebijakan yang diambil oleh pemerintahan Indonesia tidak selaras dengan komitmen peralihan penggunaan energi. Misalnya saja pada target produksi batu bara yang naik dari 663 juta ton menjadi 694,5 juta ton pada tahun 2023 Muliawati, 2023. Selanjutnya, Peraturan Pemerintah Pengganti Undang-undang Perppu tentang Cipta Kerja juga membebaskan iuran produksi batu bara hingga 0% Alaydarus, 2023. Selain itu, RUU EB-ET yang menjadi salah satu bentuk komitmen penggunaan EB-ET di Indonesia juga tidak memberikan titik terang bagi peralihan energi. Sebaliknya, RUU EB-ET malah memberikan ruang bagi energi fosil, khususnya turunan batu bara, untuk terus berkembang. Dari pandangan penulis, terdapat dua faktor gagalnya UU EB-ET memprioritaskan energi berkelanjutan pada pembahasannya kelompok masyarakat yang tidak dilibatkan dan langgengnya oligarki pada bisnis batu bara di Indonesia. Pangsa penggunaan batu bara juga telah berkembang berkali-kali lipat telah terjadi di Indonesia Hashem, 2023. Dari yang hanya 13% pada 2004, pangsa batu bara telah naik hingga 61% pada tahun 2021 Hashem, 2023. Akhirnya, ekspansi batu bara besar-besaran ini telah mengakibatkan berbagai dampak negatif. Penambangan dan penggunaan batu bara telah menempati posisi kedua dalam sumber emisi gas rumah kaca di Indonesia Hashem, 2023. Kerusakan tanah, lingkungan sekitar yang tercemar, perubahan ekosistem sekitar, serta keamanan masyarakat yang tidak terjamin juga terjadi dalam lokasi tambang di Indonesia Fitriyani, 2018.Lalu, mengapa Indonesia sangat tergantung terhadap penggunaan batu bara? Gencarnya elektrifikasi menjadi salah satu alasan utama penggunaan batu bara di Indonesia. Keberhasilan elektrifikasi yang tampak pada pencapaian rasio elektrifikasi hingga 99,63% menunjukkan usaha Indonesia agar seluruh masyarakat mendapatkan akses listrik Kementerian ESDM, 2023. Akhirnya, batu bara digunakan sebagai sumber utama elektrifikasi karena batu bara adalah akses yang paling cepat untuk memenuhi tujuan tersebut. Batu bara dan energi-energi fosil lainnya juga memberikan efek positif bagi nilai ekspor Indonesia. Batu bara memberikan dampak terbesar dalam nilai positif perdagangan energi fosil hingga 6,8 triliun pada tahun 2022 KOMINFO, 2023. Dampak sosial ekonomi juga dirasakan oleh masyarakat sekitar penambangan batu bara. Meningkatnya peluang usaha milik masyarakat, peluang tenaga kerja yang semakin meluas, serta subsidi terhadap masyarakat sekitar telah dirasakan oleh masyarakat yang tinggal di sekitar penambangan batu bara Nggeboe, 2017. Namun, hal-hal di atas tidak dapat menjustifikasi kerusakan lingkungan dan emisi karbon yang dihasilkan dari penambangan batu bara. Maka dari itu, sebuah pengaturan terhadap pelaksanaan dan penggunaan energi fosil serta dukungan pada EB-ET perlu Undang-undang Energi Baru dan Energi Terbarukan Bentuk Kepentingan Ekonomi Para Elite PolitikIlustrasi tambang batu bara Foto Sigid Kurniawan/AntaraUndang-undang Nomor 30 Tahun 2007 tentang Energi masih menjadi dasar dalam pengaturan penggunaan energi di Indonesia. UU ini mengatur pengelolaan energi yang memegang prinsip berkeadilan, berkelanjutan optimal, dan terpadu Pemerintah, Indonesia, 2007. Selain itu, Undang-undang Nomor 30 Tahun 2009 mengatur tentang kelistrikan yang menjamin kualitas dan kuantitas listrik bagi publik Pemerintah Indonesia, 2009. Lalu, dengan adanya komitmen Indonesia terhadap pencegahan perubahan iklim dan peralihan energi, Rancangan Undang-undang Energi Baru dan Energi Terbarukan RUU EB-ET menjadi agenda utama untuk pengaturan energi saat ini. Pengaturan dan peralihan terhadap energi terbarukan serta pencarian energi baru yang dapat menggantikan energi fosil menjadi inti dari RUU sejak RUU ini masuk ke Program Legislasi Nasional Prolegnas pada tahun 2019, RUU EB-ET tidak kunjung menemukan titik cerah. Menurut analisis penulis, berbagai kepentingan dari negara, para pebisnis dan politisi yang berkomplotan, serta masyarakat yang tidak dapat diampu dalam RUU ini mengakibatkan terhambatnya pembahasan dan pengesahan RUU EB-ET serta gagalnya komitmen Indonesia dalam peralihan energi. Tanpa disadari, oligarki pada sistem energi, khususnya batu bara, terjadi di Indonesia Singgih, 2022. Sebut saja Luhut Binsar Pandjaitan, Menteri Koordinator Bidang Kemaritiman dan Investasi, yang memiliki tugas koordinasi untuk 7 kementerian dan lembaga sekaligus, termasuk Kementerian Energi dan Sumber Daya Mineral ESDM dan Kementerian Lingkungan Hidup dan Kehutanan. Walaupun memegang peran penting dalam aksi peralihan energi di Indonesia, sejak 2004, Luhut masih mengembangkan PT Toba Sejahtra, sebuah perusahaan yang bergerak di bidang energi dan pertambangan batu bara, yang memiliki luas pertambangan baru bara hingga hektare di Kalimantan Timur. Tidak hanya Luhut, berbagai nama terkenal, seperti Prabowo Subianto dan Sandiaga Uno hingga pebisnis-pebisnis batu bara yang memiliki dukungan dari para politisi juga mewarnai pelanggengan bisnis batu bara di kepentingan antara mencari keuntungan ekonomi dan melancarkan aksi peralihan energi terjadi dalam lingkup pembahasan RUU EB-ET. Kepentingan-kepentingan para pemangku inilah yang menghambat RUU EB-ET untuk sesuai dengan peralihan energi menuju energi yang masyarakat yang seharusnya menjadi garda terdepan dalam produksi dan pengelolaan EB-ET juga seakan tidak dilibatkan dalam prosesnya. Masyarakat seakan hanya digunakan sebagai konsumen energi saja. Bagaimana tidak? Partisipasi masyarakat yang diatur dalam RUU EB-ET terbatas pada pemberian masukan, pengajuan keberatan, inisiatif perorangan, dan pengawasan evaluasi terhadap kebijakan EB-ET. RUU EB-ET juga berfokus hanya pada perizinan dan pengusahaan serta penyediaan dan pemanfaatan EB-ET melalui pemerintahan dan bukan partisipasi masyarakat. Hal tersebut menyebabkan RUU EB-ET tidak melihat masyarakat sebagai aktor utama dalam penyediaan dan pengelolaan EB-ET. RUU EB-ET Bentuk Pelanggengan Energi Fosil di IndonesiaSelain minimnya partisipasi masyarakat dan langgengnya oligarki bisnis batu bara di Indonesia, RUU EB-ET juga memberikan wadah bagi energi fosil untuk terus digunakan dalam masa peralihan energi. Dari analisis penulis, berbagai produk turunan batu bara, seperti batu bara tergaskan, batu bara tercairkan, dan gas metana batu bara, tidak sesuai dengan komitmen peralihan energi yang dimiliki turunan batu bara yang terdapat pada RUU EB-ET hanya akan terus melanggengkan pengerukan dan penggunaan batu bara sebagai sumber energi. Hal ini mengartikan bahwa kerusakan lingkungan hingga naiknya gas emisi rumah kaca akan terus terjadi pada praktik RUU EB-ET ke depannya. Maka dari itu, transisi energi pada RUU EB-ET seharusnya melibatkan energi-energi baru dan terbarukan yang berkepanjangan dan ramah lingkungan serta menghapuskan energi-energi berbasis fosil untuk terus berkembang dalam pelaksanaan RUU Energi Baru dan Energi Terbarukan Solusi Peralihan EnergiKonsep transisi energi yang dirancang oleh Indonesia masih terpusat pada kepentingan pemerintahan. Padahal, konsep energi baru dan energi terbarukan EB-ET sangatlah simpel melihat potensi energi di sekeliling kita. Potensi EB-ET yang sangatlah besar memerlukan pengoptimalan dari sumber energi melalui partisipasi masyarakat yang masif karena menunjukkan berbagai keuntungan. Biaya pembangunan dan pemeliharaan yang lebih murah, sumber yang dapat ditemukan sehari-hari, serta ramah lingkungan Janitra, 2022 menjadikan EB-ET sesuai dengan komitmen Indonesia dalam pencegahan perubahan iklim dan peralihan dan peralihan menuju EB-ET memerlukan kerja sama dari berbagai pihak yang terlibat. Pemerintah yang mengatur regulasi dapat mengakomodasi penggunaan EB-ET secara menyeluruh. Penyediaan teknologi serta kemampuan finansial dan pengetahuan dalam pengembangan inovasi EB-ET juga dapat menjadi tanggung jawab pemerintah. Masyarakat yang memiliki sumber daya dalam pengelolaan EB-ET memerlukan pengetahuan mengenai pengelolaan EB-ET itu sendiri. Masyarakat juga perlu mengambil bagian dalam perubahan budaya konsumsi yang selama ini sangat bergantung pada energi fosil. Industri-industri juga harus ikut dalam komitmen penggunaan energi terbarukan tersebut. Dalam melaksanakan kebijakan pengelolaan EB-ET, seluruh instrumen yang ada harus memiliki kemauan yang kuat serta kerja sama untuk menciptakan dan menggunakan EB-ET dan lingkungan yang lebih EB-ET sebagai sebuah wadah bagi EB-ET untuk terus berkembang seharusnya berpihak pada komitmen dasar pembentukan UU ini, yaitu komitmen peralihan energi di Indonesia. RUU EB-ET seharusnya menjadi kerangka peraturan yang dapat meningkatkan partisipasi berbagai aktor yang terlibat, termasuk pemerintahan, pebisnis, dan masyarakat, untuk mendukung peralihan energi. Untuk itu, prioritas pengembangan energi terbarukan yang berkelanjutan harus menjadi agenda utama dalam RUU EB-ET. Energi fosil, khususnya batu bara, yang masih dilanggengkan oleh RUU ini harus ditinjau kembali melihat hal tersebut tidak sesuai dengan komitmen yang ada. Jadi, RUU EB-ET harus menjadi tempat bagi kepentingan peralihan energi terbarukan dan bukan kepentingan para aktor untuk meraih keuntungan ekonomi yang dimiliki. Subsequently, CIL awarded the contract for supply of lakh tonnes of imported coal to PT Bara Daya Energy Ltd consortium to the interested gencos during August and September, sources said. The gencos that have expressed their willingness to buy imported coal are CESC, Adhunik Power, Rattan India, Sai Wardha, Avantha Power & Infrastructure Ltd, Jindal India Thermal Power Ltd, Lanco Amarkantak Power Ltd, KSK, ACB India and D B Power. While lakh tonnes of coal would be imported for the month of August, lakh tonnes would be shipped for the month of September. Coal India, in its board meeting held on July 8, decided to cancel the short-term tender of MT and supply the indented imported coal quantity against medium-term tender of east and west coast, sources said. In an order that will bring relief to over 500 plot owners of Lotus City that was launched by the beleaguered 3Cs Group along the Yamuna Expressway almost a decade ago, the National Company Law Tribunal NCLT has approved the resolution plan submitted by Ace Infracity Developers Private Ltd. The NCLT did not entertain the objections put forward by the Yamuna Expressway Industrial Development Authority YEIDA, the land allotting body, and held that the amount of Rs 67 crore being brought in by the corporate debtor was sufficient for them to settle their dues. Under the resolution plan, allottees will get possession of 512 residential plots of the Lotus City project, valued at Rs 211 crore after it is developed. The term of this plan is 24 months within which the plots would be developed and delivered. Legal experts say that the order will not only bring relief to hundreds of families of this project but also clear the way for similar projects that are stuck due to disagreements with development authorities. The NCLT bench observed the resolution plan submitted by Ace Infracity Developers has been approved by the committee of creditors CoC with 100 percent votes and it cannot "interfere with the commercial wisdom" of the lenders. “As per our best estimate, the principal amount payable to YEIDA amounts to Rs crore and lease rent of Rs crore already paid …,” the order said. YEIDA had objected to the resolution plan, stating, “The Resolution Plan in its current form results in the Resolution Applicant acquiring approximately 100 acres of land on payment of a mere pittance of Rs crores towards outstanding dues and Rs 506 crore payable by the Corporate Debtor in terms of lease deed.” Piyush Singh, founding partner of PSP Legal, who represented buyers before the Supreme Court, NCLT and the National Company Law Appellate Tribunal NCLAT, said, "This judgment will not only bring relief to hundreds of families but also clear the path for more resolution plans which are stuck due to non-cooperation of authorities like NOIDA New Okhla Industrial Development Authority, Greater Noida Authority, YEIDA, etc. The authorities should keep the interest of the allottees over the unnecessary and avoidable litigation." “The NCLT has noted that Rs 67 crore that is being brought in as the principal amount by Ace is sufficient for YEIDA which had earlier raised a claim of around Rs 506 crore,” he added. The order A two-member bench of the NCLT in a June 14 order said the application "which is for approval of the Resolution Plan is allowed and the Resolution Plan of Rs crore is hereby approved". The tribunal said that the resolution plan submitted by Ace Infracity Developers is now "binding on the Corporate Debtor Three C Homes and other stakeholders" and shall come into force with immediate effect". In its 27-page long order, the NCLT said it is "satisfied that the Resolution Plan has made adequate provisions with respect to all the objections raised by" YEIDA. "The Monitoring Committee shall continue till the closing date. The Resolution Applicant would take a RERA Re-registration for the completion of the work as defined above," it said. Homebuyers’ take According to the order, the term of this resolution plan is 24 months “from the effective date” within which the plots would be developed and delivered. Amit Tyagi, a core member of Lotus City Plots Buyers Association, told Moneycontrol that they had finally received justice. “The incoming company will now have to fulfil all the liabilities of the old company. It will now have to provide for peaceful possession of the plots, provide for sewage facilities, level the land, roads, lights, club facilities and also seek for fresh approvals from the authority such as re-registration from the state RERA Real Estate Regulatory Authority for completion of the work,” he explained. Buyers have already paid around 65 percent of the cost of the plots, he said. “Going forward, a monitoring committee that will have two homebuyers as representatives, two representatives of Ace and the resolution professional will also be set up whose task will be to ensure that the entire resolution plan is delivered on ground,” he added. The back story The corporate insolvency resolution process was initiated by the NCLT against Three C Homes Private Limited on September 6, 2019. Gaurav Katiyar was appointed interim resolution professional IRP. He had selected two eligible prospective resolution applicants for submission of bids, East India Udyog Ltd, which was in a joint venture with Ashiana Housing, and Ace Infracity Developers. Two others, ND Software, a partnership firm, and Harshvardhan Reddy, were found ineligible. The CoC in its fifth meeting in 2020 opted for Ace Infracity's bid. On February 8, 2021, the NCLT had rejected the plea filed by the IRP seeking approval of the resolution plan, following opposition by some of the allottees. This was challenged before the NCLAT by the homebuyers’ association. On July 8, 2021, NCLAT remanded the matter back to the NCLT and directed that benefits of homebuyers be reconciled in the approved resolution plan. It had also impleaded the YEIDA to determine the status of the dispute with the farmers from whom the land was acquired. Lotus City Plot Buyers Welfare Association filed an appeal before the Supreme Court against the NCLAT order. The court remanded the case back to the tribunal. HRUM menyampaikan tertarik melakukan investasi pada proyek High Pressure Acid Leaching HPAL.CEO Harum Energy Ray Antonio Gunara mengatakan pihaknya sangat tertarik untuk berinvestasi pada proyek HPAL. Menurutnya, investasi pada proyek HPAL memberikan akses bagi HRUM untuk masuk ke industri baterai yang merupakan hilir nikel. "Tapi saat ini kami masih dalam tahap penjajakan, tahap awal, yang merupakan bagian dari strategi HRUM," kata Ray dalam paparan publik, dikutip Minggu 11/6/2023.Ray melanjutkan, HRUM akan terus menjajaki peluang ekspansi di sektor nikel, baik hulu maupun hilir.
